1. Acceptance of Terms

Welcome to SweatPoint. By accessing or using the SweatPoint mobile application ("Application"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you may not use our Application.

These Terms constitute a legally binding agreement between you ("User" or "you") and SweatPoint ("we", "us", or "Company").

2. Definitions

• "Application" means the SweatPoint mobile application for iOS and Android
• "Services" means all features and functions provided through the Application
• "Account" means a registered user account in the Application
• "Sweatpoints" means virtual reward points earned through activities in the Application
• "Content" means text, images, videos, data, and other materials uploaded or shared
• "Classes" means fitness sessions offered through the Application

3. Eligibility and Account Registration

3.1 Age Requirements

• You must be at least 13 years old to use the Application
• Users aged 13-17 require parental or guardian consent
• By registering, you confirm that you meet the age requirements

3.2 Account Registration

To use the Services, you must:

• Provide accurate, complete, and current information
• Maintain the security of your password
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

3.3 Account Restrictions

You may not:

• Create more than one account
• Use another person's account without permission
• Sell, transfer, or share your account
• Use false names or information
• Create an account if we have previously terminated your account

4. Use of Services

4.1 License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application for personal and non-commercial purposes.

4.2 Permitted Use

You may use the Application to:

• Track your fitness activities and exercises
• Record food intake and nutrients
• Register and attend fitness classes
• Earn and redeem Sweatpoints
• Interact with community features (if available)

4.3 Prohibited Use

You may NOT:

Illegal Activities:

• Use the Application for any illegal purpose
• Violate any local, state, or international laws
• Infringe on intellectual property rights of others

System Abuse:

• Attempt to access our systems or networks without authorization
• Interfere with or disrupt the Services
• Use bots, scripts, or automation without permission
• Manipulate the Sweatpoints or rewards system
• Exploit bugs or vulnerabilities for gain

Harmful Content:

• Upload viruses, malware, or harmful code
• Send spam or unsolicited messages
• Spread false or misleading information

Inappropriate Behavior:

• Harass, threaten, or intimidate other users
• Post offensive, obscene, or inappropriate content
• Impersonate any person or entity
• Collect personal information of other users

5. Sweatpoints System

5.1 How to Earn Sweatpoints

You can earn Sweatpoints through:

• Completing exercises and fitness activities
• Recording food and nutrition
• Attending fitness classes
• Achieving daily and weekly goals
• Participating in challenges and special events

5.2 Value and Calculation

• Sweatpoints have no real monetary value
• Points calculation is at our discretion
• We reserve the right to adjust point earning rates at any time
• Changes will be notified to users in advance

5.3 Sweatpoints Redemption

• Sweatpoints can be redeemed for rewards in the Sweatpoints Store
• Rewards are subject to availability
• Redemptions are final and cannot be reversed
• We reserve the right to limit or modify redemption options

5.4 Expiration and Cancellation

• Sweatpoints may expire after a period of inactivity (will be notified)
• We reserve the right to cancel points earned through fraud or abuse
• Cancelled points cannot be recovered
• No refunds or compensation for cancelled points

5.5 No Cash Value

• Sweatpoints cannot be converted to cash
• Sweatpoints cannot be transferred to other users
• Sweatpoints have no value if account is terminated

6. Fitness Classes

6.1 Class Registration

• Class registration is subject to availability
• You must register in advance to attend classes
• We reserve the right to reject or cancel registrations

6.2 Cancellations and No-Shows

• You may cancel registration according to class cancellation policy
• Repeated no-shows may result in registration restrictions
• Late cancellations may result in point penalties

6.3 Class Conduct

• You must comply with instructor rules and instructions
• Disruptive behavior may result in removal
• You are responsible for your own safety

6.4 Schedule Changes

• We reserve the right to modify or cancel classes at any time
• You will be notified of changes via application notifications
• No compensation for classes cancelled by us

7. User Content

7.1 Content Ownership

• You retain ownership of content you upload
• By uploading, you grant us a license to use that content

7.2 License to Us

You grant us a worldwide, royalty-free, non-exclusive license to:

• Store and display your content
• Use content to provide the Services
• Modify content for technical purposes (e.g., resizing images)
• Use aggregated content for analysis and improvement

7.3 Content Responsibility

You are responsible for ensuring your content:

• Does not violate the rights of others
• Does not contain false or misleading information
• Is not offensive or inappropriate
• Complies with all applicable laws

7.4 Monitoring and Removal

• We reserve the right (but are not obligated) to monitor content
• We may remove content that violates these Terms
• We may terminate accounts of repeat violators

8. Intellectual Property Rights

8.1 Our Ownership

The Application and all its content (including but not limited to):

• Source code and software
• Designs, logos, and trademarks
• Text, graphics, and images
• Algorithms and formulas

are the exclusive property of SweatPoint and protected by intellectual property laws.

8.2 Restrictions

You may not:

• Copy, modify, or distribute the Application
• Reverse engineer or decompile the Application
• Use our logos or trademarks without written permission
• Create derivative works based on the Application

9. Health Advice and Medical Disclaimer

9.1 Not Medical Advice

• This Application is NOT a substitute for professional medical advice
• Content is for informational and educational purposes only
• Always consult healthcare professionals before starting exercise programs
• Do not disregard medical advice because of information in the Application

9.2 Health Risks

• Physical activity involves risk of injury
• You are responsible for assessing exercise suitability for yourself
• Stop exercising if you experience pain or discomfort
• Get medical clearance if you have pre-existing health conditions

9.3 Information Accuracy

• We strive to provide accurate information
• We do not guarantee accuracy of calorie, nutrient, or health data
• Information may not be suitable for all individuals
• Use information at your own risk

10. Privacy and Data Protection

10.1 Data Collection

Your use of the Application is subject to our Privacy Policy, which is part of these Terms. Please read our Privacy Policy to understand how we collect, use, and protect your data.

10.2 Consent

By using the Application, you consent to:

11. Payments and Purchases

• We discontinue Application operations

12.3 Effects of Termination

After termination:

• Your access to the Application will be terminated
• Your account data will be deleted according to Privacy Policy
• Unredeemed Sweatpoints will be forfeited
• You are not entitled to refunds or compensation

13. Warranty Disclaimer

13.1 "AS IS" Basis

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of accuracy or reliability
• Warranties of non-infringement

13.2 No Guarantees

We do not guarantee that:

• The Application will be error-free or bug-free
• Services will be uninterrupted or secure
• Results obtained will be accurate or reliable
• Defects will be corrected

14. Limitation of Liability

14.1 Exclusion of Damages

TO THE EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Damages arising from use or inability to use the Application

14.2 Maximum Liability

If we are found liable, our liability is limited to the amount you paid us in the preceding 12 months, or RM100, whichever is lower.

14.3 Jurisdictional Exceptions

Some jurisdictions do not allow certain exclusions or limitations, so the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless SweatPoint, our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Application
• Violation of these Terms
• Violation of third-party rights
• Content you upload or share

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Malaysia without regard to conflict of law principles.

16.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Malaysian courts.

16.3 Initial Negotiation

Before initiating legal action, parties agree to attempt to resolve disputes through good faith negotiation.

16.4 Arbitration (Optional)

If negotiation fails, disputes may be referred to binding arbitration according to Malaysian arbitration rules.

17. Miscellaneous

17.1 Entire Agreement

These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Application.

17.2 Changes to Terms

• We reserve the right to modify these Terms at any time
• Significant changes will be notified via application or email
• Continued use after changes means acceptance of new Terms

17.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.4 Waiver

Our failure to enforce any right or provision shall not be deemed a waiver of such right.

17.5 Assignment

We may assign our rights and obligations under these Terms without your consent. You may not assign your rights without our written consent.

17.6 No Agency

Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and us.
